The Supreme Court's decision emphasized that merely implementing an abstract idea on a computer does not qualify for patent protection. As a result, we have seen many AI patents getting rejected in the US patent office, while China emerging as a global leader in AI patents, accounting for more than 70% of AI-related patents issued worldwide. The high volume of patents underscores China's aggressive pursuit of innovation and technological leadership in AI, contrasting with the more stringent patenting standards in other jurisdictions like the U.S. and Europe.
Copyright Protection of AI
While the Copyright Act does not explicitly define the term "author," courts and the U.S. Copyright Office have consistently determined that authors must be human. This principle was notably affirmed in the "monkey-selfie" case, where the U.S. Court of Appeals for the Ninth Circuit held that a monkey had no rights to photographs it took of itself (Naruto v. Slater, 888 F.3d 418 (9th Cir. 2018)). Following this case, the U.S. Copyright Office reinforced the requirement that a work of authorship must be created by a human, a stance confirmed by the U.S. District Court for the District of D.C. Similarly, the doctrine of "work made for hire" does not extend to commissioned works of computer software. On March 16, 2023, the U.S. Copyright Office issued a statement of policy to clarify its practices for examining and registering works that contain material generated by the use of artificial intelligence (AI) technology (88 Fed. Reg. 16190). This guidance imposes specific requirements on copyright applicants who use AI technology in creating a work, including:
- Disclosure: Applicants must disclose the inclusion of AI-generated content in a work submitted for registration.
- Explanation: Applicants must provide a brief explanation of the human author’s contributions to the work.
The guidance also notes that works containing AI-generated material may be copyrighted to the extent that they contain sufficient human authorship to meet the standard for copyright protection. This can be achieved through selecting or arranging AI-generated material in a sufficiently creative way that the resulting work constitutes an original work of authorship or modifying material originally generated by AI technology to such a degree that the modifications meet the standard for copyright protection.

Trade Secrets in AI

These include regularly identifying critical AI technology requiring protection, restricting access to sensitive information, clearly marking confidential data, implementing robust security measures, developing comprehensive written policies, using non-disclosure agreements, and allocating significant resources to protect key AI assets like source code and training datasets.
Trade secret protection offers several advantages for AI innovations. Unlike patents or copyrights, trade secrets can potentially last indefinitely as long as they remain secret. They don't require a registration process, avoiding delays and public disclosure. This protection is also flexible, covering a wide range of information that might not qualify for other forms of intellectual property protection.
However, relying on trade secrets also presents challenges. Maintaining trade secret status demands continuous, substantial efforts to keep the information confidential. There's always a risk of disclosure, especially in collaborative AI development environments, which could lead to the loss of protected status. New York Times Case Against OpenAI : Similarly, The New York Times has taken legal action against OpenAI, alleging that the AI company used its articles to train language models without proper authorization. This case underscores the broader issue of how data is sourced and used in training AI models. The core of the dispute lies in whether the data scraping from publicly accessible sources constitutes copyright infringement, especially when the resulting AI applications generate content that may potentially compete with or diminish the value of the original works. Both these cases are currently pending in the district court, and it will take some time for the court to make a decision (if at all) on the issues that have been raised in the district court.

This raises significant questions about the extent to which AI can replicate a person’s voice or image without their consent and the potential legal implications of such uses. This area of law aims to balance innovation in AI with the personal rights of individuals.
Data Protection and Privacy
